Terms of Service

Last Updated: October 2026

Important Notice for Australian Consumers: Our goods and services come with guarantees that cannot be excluded under the Australian Consumer Law (“ACL”). Nothing in these Terms of Service purports to exclude, restrict, or modify your statutory consumer rights under Schedule 2 of the Competition and Consumer Act 2010 (Cth).

1. Acceptance & Agreement to Terms

These Terms of Service (“Terms”) form a legally binding contract between you (“User”, “Host”, “Attendee”, or “you”) and BuzzInvite (“we”, “us”, or “our”), governing your access to and use of the BuzzInvite website, web applications, event creation tools, QR code generation, photo galleries, and RSVP management services (collectively, the “Platform”).

By creating an account, publishing an event, scanning a BuzzInvite QR code, or submitting an RSVP, you confirm that you have read, understood, and agreed to be bound by these Terms and our Privacy Policy. If you do not agree, you must immediately cease accessing or using the Platform.

2. Australian Consumer Law (ACL) & Consumer Guarantees

Statutory Consumer Rights Protected

Under the Australian Consumer Law (Schedule 2 of the Competition and Consumer Act 2010 (Cth)), consumers are entitled to statutory guarantees that services will be provided with due care and skill, will be fit for purpose, and will be supplied within a reasonable time.

Nothing in these Terms operates to exclude, restrict, or modify any condition, warranty, right, or remedy conferred on you by the Australian Consumer Law or any other applicable Australian Commonwealth, State, or Territory law that cannot be lawfully excluded or limited (“Non-Excludable Rights”).

To the maximum extent permitted by law, where services supplied are not of a kind ordinarily acquired for personal, domestic, or household use, our total aggregate liability for breach of a Non-Excludable Guarantee is limited at our option to: (a) re-supplying the services; or (b) paying the cost of having the services supplied again, in accordance with section 64A of the ACL.

3. Platform Nature & Scope of Service

BuzzInvite operates strictly as an intermediary technology platform. We provide cloud-based software tools for Hosts to create digital invitation pages, generate QR codes, track capacities, and collect RSVPs from Guests.

BuzzInvite is NOT the Event Organiser or Caterer:

BuzzInvite is not an event promoter, producer, ticket broker, venue manager, food caterer, or insurer. All events displayed on the Platform are created and managed independently by third-party Hosts. We have no control over and make no representations regarding the quality, safety, legality, timing, food safety, or actual occurrence of any event.

4. Eligibility & Host Accounts

To create an account and host events on BuzzInvite:

  • You must be at least 18 years of age or possess legal capacity to enter into binding agreements under Australian law;
  • You must provide accurate, current, and complete registration information;
  • You are strictly responsible for maintaining the confidentiality of your login credentials and for all activities that occur under your account;
  • You must immediately notify BuzzInvite of any unauthorized account access or security breaches.

5. Host Responsibilities & Legal Compliance

When creating and publishing an event, you agree that you:

  • Comply with Australian Laws: Ensure your event complies with all relevant local, state, and federal laws, including venue permits, liquor licensing, fire safety limits, working with children requirements, and food safety standards.
  • Spam Act 2003 (Cth) Compliance: Do not use BuzzInvite to send unsolicited bulk communications. When sending invitations or notifications, you must ensure you have prior consent from your recipients.
  • Privacy Act & Attendee Data Handling: When accessing attendee lists or exporting CSV rosters, you must treat guest personal information (including names, contact numbers, and sensitive dietary/allergy requirements) with strict confidentiality and in accordance with the Privacy Act 1988 (Cth).
  • Misleading or Deceptive Conduct: You must not engage in conduct that is misleading or deceptive, or likely to mislead or deceive (under section 18 of the ACL), regarding event location, pricing, lineup, catering, or host affiliation.

6. Attendee & Guest Terms

When responding to an invitation or attending an event organized via BuzzInvite:

  • Accurate RSVPs: You agree to provide true and accurate information regarding your name, headcount, and attendance status.
  • Dietary Requirements & Food Allergies: While BuzzInvite enables you to note dietary restrictions and food allergies, you acknowledge that BuzzInvite does not prepare or serve food and is not a food-safety or medical service. We do not check, and cannot guarantee, that a Host reads, passes on or acts on what you enter. For any allergy or medical dietary need, you must confirm directly with the Host or venue before and at the event, and you attend and eat at your own risk. Never rely on BuzzInvite as the only way to tell a Host about a serious allergy.
  • RSVP Edit Tokens: BuzzInvite generates a unique management token allowing you to update your RSVP. You are responsible for keeping this link confidential to prevent unauthorized modifications to your response.

7. Acceptable Use Policy & Prohibited Conduct

You agree not to use the Platform to:

Illegal or Fraudulent Events

Host events that promote illegal activities, scams, fraudulent solicitations, or deceptive schemes.

Hate Speech & Harassment

Publish content that is defamatory, abusive, threatening, racially abusive, or promotes violence.

Platform Tampering

Deploy automated scrapers, spiders, malware, DDoS attacks, or reverse-engineer the codebase.

IP Infringement

Upload cover photos, trademarks, or materials that infringe on third-party intellectual property rights.

We reserve the right to review, suspend, or permanently remove any event or account that violates this Acceptable Use Policy without prior notice.

8. QR Codes

BuzzInvite generates QR codes that link to an event invitation or photo gallery. We grant Hosts a revocable, non-exclusive license to download, print, and display these QR codes for the purpose of their events. QR codes are not a security or entry-control system, and we do not guarantee that a code will scan or keep working. You agree not to misuse the codes or use them to direct people to harmful or misleading destinations.

9. Intellectual Property & User Content

Our Intellectual Property: The Platform, including software, layouts, logos, branding, QR generation algorithms, and text content (excluding User Content), is owned by BuzzInvite and protected by Australian and international copyright, trade mark, and design laws.

User Content License: You retain ownership of all images, logos, event descriptions, and media you upload (“User Content”). By uploading User Content, you grant BuzzInvite a non-exclusive, royalty-free, worldwide license to host, display, resize, cache, and transmit such content solely for the purpose of providing the Platform services.

You represent and warrant that you own or have obtained all necessary licenses, permissions, and rights to submit your User Content in compliance with the Copyright Act 1968 (Cth).

10. Limitation of Liability

The Platform is provided free of charge unless we tell you otherwise. To the maximum extent permitted by the Australian Consumer Law and other applicable laws:

  • As is: The Platform is provided “as is” and “as available”. We give no warranty that it will be uninterrupted, error-free, secure, accurate or suitable for your purposes, including that invitations, reminders and other emails will be delivered or read, that RSVP, headcount, capacity or visitor figures will be accurate, or that content will be kept or recoverable.
  • Events and other people: We are not responsible or liable for any event, any Host, guest or other user, or any act or omission of any of them. This includes injury, illness (including allergic reactions and food-safety incidents), loss, damage, cancellations, disputes, and any use, misuse, loss or disclosure of information or content by a Host, guest or other third party.
  • Third-party services: The Platform relies on third-party services such as hosting, database, email, storage, analytics and sign-in providers. We are not liable for their failures, outages, security incidents or acts.
  • Excluded losses: We are not liable for any indirect or consequential loss, loss of profits, revenue, opportunity or goodwill, loss or corruption of data, or loss of reputation, however caused and even if foreseeable.
  • Your use at your own risk: You use the Platform and attend events at your own risk. You release us from claims arising from them to the extent the law allows.

Nothing in these Terms limits or excludes any right or liability that cannot be excluded or limited by law, including under the Australian Consumer Law, and liability for fraud. Where a guarantee cannot be excluded and the services are not of a kind ordinarily acquired for personal, domestic or household use, our liability is limited as set out in section 2.

11. Indemnity

To the maximum extent permitted by law, you agree to indemnify and hold harmless BuzzInvite and its owners, officers, contractors and agents against all claims, losses, liabilities, damages and reasonable legal costs arising from: (a) your breach of these Terms; (b) your violation of any law or third-party rights; (c) content you publish or upload; (d) any event you organise or host, including claims by guests; or (e) how you collect, use, store, export or share guest information, including any breach of privacy law by you. This does not apply to the extent a loss is caused by our own fraud or wilful misconduct.

Photos, Guest Information & Your Data

  • Photos: Only upload photos you have the right to share, and do not upload unlawful, abusive or explicit images, or photos of people who would object. Hosts can remove any photo in their event gallery, and we may remove photos that breach these Terms. We do not review uploads in advance and are not responsible for photos or other content uploaded by Hosts or guests.
  • Hosts are responsible for guest data: A Host decides what information to collect from guests and is responsible for how they use, store, export and share it. Hosts must use it only to organise their event, keep it secure, and delete it when it is no longer needed. See our Privacy Policy for how we handle it.
  • No responsibility for your data once others hold it: BuzzInvite is not responsible or liable for how any Host, co-host or guest collects, uses, discloses, exports, stores or deletes information or photos, including anything downloaded as a CSV roster, screenshotted, shared by link or kept outside the Platform. If you give information to a Host or upload content to an event, you do so at your own risk, and any complaint about a Host's handling of it is a matter between you and that Host.
  • Your own data and backups: You are responsible for the accuracy of the content you submit and for keeping your own copies of anything you need (such as guest lists). We do not guarantee that content will be retained, recoverable or free from loss, and we are not liable for loss or corruption of data except where the law does not allow us to exclude that liability.

Termination & Account Deletion

You may stop using the Platform at any time, and you can delete your account yourself under Account settings. Deleting your account removes your profile, the events you host and their RSVPs and photos, as described in our Privacy Policy.

We may suspend or close an account or remove content if you seriously or repeatedly breach these Terms, or if we need to for legal or security reasons. Where reasonably practicable we will tell you why. Sections that by their nature should continue (such as liability, intellectual property and governing law) survive termination.

Changes to the Service

We may change, limit, suspend or discontinue any part of the Platform at any time, including free features, and we will give reasonable notice where practicable. We are not liable to you for doing so, except as the law requires. Please export or keep your own copy of anything you need.

General

  • Severability: If any part of these Terms is found unenforceable, it is removed or limited to the extent needed and the rest continues to apply.
  • Entire agreement: These Terms and the Privacy Policy are the whole agreement between you and us about the Platform.
  • No waiver: If we do not enforce a right straight away, we have not given it up.
  • Events beyond our control: We are not liable for failure or delay caused by events outside our reasonable control, including outages of internet, hosting or other third-party services.
  • Assignment: We may transfer our rights and obligations under these Terms to a successor to the Platform. You may not transfer yours without our written consent.
  • Notices: We may give you notice by email to your account address or by posting it on the Platform.

12. Variation of Terms

In accordance with Australian fair contract standards, we may update these Terms from time to time. When changes are material, we will provide reasonable advance notice (e.g., via email or a prominent notification on the Platform). If you do not agree to the revised Terms, you may delete your account and stop using the Platform prior to the effective date. Continuing to use the Platform after that date means you accept the revised Terms.

13. Dispute Resolution & Governing Law

Informal Negotiation: If a dispute arises, the parties agree to first attempt in good faith to resolve the dispute through informal negotiations by submitting an inquiry through platform support before initiating formal legal proceedings.

Governing Law: These Terms are governed by and construed in accordance with the laws of the State of New South Wales and the Commonwealth of Australia.

Jurisdiction: Both you and BuzzInvite submit to the non-exclusive jurisdiction of the courts of New South Wales, Australia, and courts hearing appeals from them.

14. Platform Support & Notices
